On 17th October 2026, Kerala State Electricity Regulatory Commission published its final Multi-Year Tariff Regulations, 2026 for control period 1 April 2027 to 31 March 2032. This is not about connection charges like OP 34/2026 — this decides HOW your monthly bill will be calculated for next 5 years. Rs 5,000 crore regulatory asset, FPPAS including short-term costly power, and peak extended to 11:30 PM — all approved by KSERC. But KSERC is not Central Government body. KSERC is State Government regulator constituted under Section 82 of Electricity Act. KSEB Ltd is 100% State Government PSU. State Government appoints regulator, owns utility, delays reforms, and now puts bill on consumer. This blog exposes State Government's role with RTI proof.

01. What Changed

KSEB filed tariff framework petition based on regulatory gap accumulated up to 31st March 2024. Public hearings held 29-30 Sep 2026 after draft published 24 Aug 2026. Addendum on 8 Sep 2026. Final order published 17 Oct 2026 by State regulator.

As per The Hindu 19 Oct 2026: "The measures are part of the Kerala State Electricity Regulatory Commission's multi-year tariff regulations for the five-year control period from 2027-28 onwards. They will take effect on April 1, 2027. The existing thermal fuel surcharge formula has been replaced with a Fuel and Power Purchase Cost Adjustment Surcharge (FPPAS) mechanism."

At a glance — State Government Framework:
• Control Period: 1 Apr 2027 – 31 Mar 2032 (5 years) — notified by State regulator KSERC
• RA Surcharge Period: 2027-28 to 2030-31 — Rs 5,000 crore recovery approved by State regulator for State PSU
• Legal Basis Cited: State regulator cites Central Electricity (Amendment) Rules, 2022 as enabling provision, but decision is by State regulator, not Central Government
• Peak Redefined by State: 8am-6pm solar, 6pm-11:30pm peak, 11:30pm-8am off-peak — State decision, not Central
• Owner: KSEB Ltd is 100% owned by State Government — not Central PSU

02. What KSERC Says vs Reality

State Regulator SaysReality for Consumer — State Govt Role
"Wider choice, better price signals"State Government regulator gives you choice: pay higher evening rate or shift life to 8am-6pm
"Enabling licensees to preserve financial viability"State Government PSU's financial viability = your bill. Rs 5000cr gap created during State Government tenure, recovery approved by State Government regulator
"Compliance with statutory changes"State regulator uses Central Rules 2022 as cover, but 4% auto pass-through, Rs 5000cr RA, 6-11:30pm peak are all State Government decisions

03. TRAP 1 — Rs 5,000 Crore Regulatory Asset
Created by State Government, Paid by You

First time in Kerala history RA surcharge is being collected — Rs 5,000 crore — created under State Government watch, approved by State Government regulator, to be recovered from State's consumers.

The Hindu 19 Oct 2026: "A new regulatory asset surcharge will be levied over four-year period to liquidate regulatory assets of distribution licensees including KSEB by March 31. Regulatory asset of KSEB for liquidation would amount to roughly Rs 5,000 crore."

Mathrubhumi 19 Oct 2026: "Kerala consumers are likely to face higher bills from April 1, 2027, as State Electricity Regulatory Commission has notified tariff policy to recover KSEB's past losses of Rs 5,000 crore over four years through surcharges."

Who created Rs 5,000 crore gap? State Government. By delaying true-ups 2021-2024, delaying tariff revisions, not paying subsidy on time, not collecting Rs 3,000 crore arrears from Government departments, and allowing 46.59% salary+pension (CAG) without business reforms. Gap accumulated under State Government ownership. Now State Government regulator allows recovery from you.

08. WHO IS RESPONSIBLE? State Government
Not Central, Not KSEB Alone

This is the central question this blog answers. Public blames KSEB, analysis questions KSERC, but institutional truth is State Government is 100% responsible. Not Central Government. Central Government only made enabling Rules in 2022. State Government is the one that uses those Rules to recover money, appoints regulator, owns utility, and hides information.

Three Proofs That State Government Is Behind This Mess:

PROOF 1 — State Government Appoints KSERC (Not Central): Under Section 82 of Electricity Act, 2003, KSERC Chairman and Members are appointed by State Government. Many members are ex-KSEB, ex-Power Department, ex-Chief Secretary level IAS. This creates closed loop: State Government drafts proposal via KSEB, sends 500-page annexure only KSEB can interpret, State Government appointed regulator asks KSEB for clarification, KSEB clarifies itself. Consumer never gets independent scrutiny.

PROOF 2 — State Government Owns KSEB Ltd (Not Central PSU): KSEB Ltd is 100% owned by Government of Kerala. Board, CMD, Commercial wing that prepared B.O. 358/2026 for RMD charges, tariff petition for Rs 5,000 crore — all approved by State Government before reaching KSERC. KSEB is not private company running business — it is State PSU running on State Government decisions. Salary, pension 46.59% of cost is State Government approved expense.

PROOF 3 — State Government Delays Created This Gap: Regulatory asset of Rs 5,000 crore did not fall from sky. It is accumulation of State Government's policy failure: did not revise tariff on time 2021-2024 for vote bank, did not pay subsidy on time, did not collect Rs 3,000 crore arrears from Government departments (LSGD, PWD, Water Authority), did not reduce staff cost, did not fix theft and commercial loss. When gap became too big, easy solution: put on honest paying domestic consumer via RA surcharge + FPPAS + extended peak. State Government does not know how to do business and make money for State — so it taxes via electricity bill.

State Government vs Central Government — Clear Distinction:
• Central Government made Electricity (Amendment) Rules 2022 allowing 4% auto pass-through — enabling provision
• State Government (via KSERC) DECIDED to use that provision to allow FPPAS including costly short-term power — State decision
• State Government (via KSERC) DECIDED to extend peak from 4 hours to 5.5 hours — State decision
• State Government (via KSERC) DECIDED to approve Rs 5,000 crore RA recovery for 4 years — State decision
• State Government owns KSEB, so State Government is beneficiary of Rs 1,250 crore per year recovery — improves KSEB books, reduces State budget support needed

Conclusion: Central Government gave knife, but State Government is the one cutting consumer's pocket. Blame lies with State Government.

If State Government appoints regulator, who will regulate State Government's PSU?
If State Government owns KSEB, why does it say KSEBL is private when RTI asks for land rent?
If regulatory asset is State Government's policy failure, why should consumer pay with interest?

State Government does not have revenue problem — it has business model problem. It does not know how to make KSEB run as business, collect arrears from Government departments, reduce 46.59% salary burden, stop theft. So it recovers via your monthly bill. Rs 5,000 crore RA + FPPAS + 6-11:30pm peak is not Central Government tax — it is State Government's fiscal management via electricity bill.

09. KSEBL: Private on Paper, State-Controlled in Reality
RTI 286 Proof That State Hides Truth

State Government agencies use contradictory stand. When it comes to financial control and tariff hike, KSEBL is State Government PSU — 100% owned, controlled, staff paid by State revenue. When it comes to information disclosure under RTI about use of state-owned public land, same KSEBL is described as private entity — independent corporate entity registered under Companies Act, 2013 — to deny information.

Institutional Contradiction by State Government:
• 100% Owned by State Government — no private shareholder — but called private for RTI denial
• Financial burden on State exchequer — salary+pension 46.59% (CAG) — but claims private company status
• Administrative control by State Government — CMD, Board approved by State — but claims independent corporate
• Uses state-owned public land for substations, transformer stations, poles — but whether commercial lease or RoW fees paid to Revenue/PWD remains undisclosed — State Government hides

RTI 286/IKM/2026 — Documented Proof of State Government Non-Disclosure

RTI Application RTI/286/IKM/2026 dated 15/07/2026 (Receipt PG114022607153067) filed before Information Kerala Mission (State Government IT agency for LSG) sought four specific points regarding KSEBL occupation of state-owned land. State Government agency response exposes how truth is hidden:

QueryInformation Sought from State GovernmentState Government Response
1Standard commercial lease rates or RoW fees fixed by Revenue/PWD for KSEBL occupation of state landNo point-wise reply — says not related to IKM
2Total amount collected by Revenue/PWD from KSEBL as land rent / RoW fees 2024-26Portal shows "Pending at RTI Staff" for 84 days — deemed refusal u/s 7(2)
3Certified copy of GO legally exempting KSEBL — profit-oriented corporate — from paying commercial land feesNo GO provided — if private, why exemption? If exempted, show GO
4Pending rent / lease arrears owed by KSEBL to Revenue/PWDBlurred unreadable PDF on 17/09/2026 — deliberate denial

Documented Timeline of State Government Violations — From Proof Packet:
• 15/07/2026 — RTI filed before State Government agency IKM
• 31/07/2026 — Transfer u/s 6(3) after 16 days against mandated 5 days — Sec 6(3) violation by State Government SPIO
• 07/09/2026 — Letter claims reply furnished on 03/07/2026 — 12 days BEFORE RTI filing — impossible date — State Government SPIO
• 14/09/2026 — 4th postal communication says download from Application History, but history blank as per screenshots 02/08 and 24/09 — State Government portal
• 15/09/2026 — FAA (State Government) disposes appeal within 24 hours without hearing — Sec 19(6) violation
• 07/10/2026 — Second Appeal u/s 19(3) and Complaint u/s 18(1) filed after 84 days — penalty u/s 20(1) prayed against State Government SPIO

State Government's Dual Stand Exposed: If KSEBL is private company under Companies Act, it must pay commercial rent for state-owned land like Jio, Airtel pay RoW fees. If State Government exempted it, show certified GO. If no GO, occupation without payment is illegal. If KSEBL is State Government entity, then its finances and land use must be disclosed under RTI Act. State Government cannot claim private status for non-disclosure and State PSU status for financial recovery from consumers.

KSEBL is called private when RTI asks for land rent — so State Revenue says not related.
KSEBL is called State entity when tariff hike for Rs 5,000 crore is needed — so State regulator KSERC allows recovery.
KSEB is called private when staff does mistake — so no State Government responsibility.
KSEB is called State PSU when salary needs money — so consumer bill pays 46.59% salary.

This is State Government chameleon — colour changes as per query. State Government says KSEBL is private to hide truth via RTI, but State Government controls it for spending. RTI 286 — 84 days deemed refusal, impossible dates, blank portal — is proof that State Government is not providing truth via RTI. State Government is behind this mess — not Central Government, not KSEB alone.

04. TRAP 2 — FPPAS: Costly Short-Term Power in Your Bill
State Decision

Old System: KSEB's long-term CGS and IPP purchases alone counted.

New System: State regulator now allows ALL sources including short-term exchange power @ Rs 8-12 to be counted. State regulator decision, not Central Government compulsion.

State Government allows short-term costly power to be passed directly. Kerala faces power shortage and State PSU KSEB buys short-term at Rs 8-12/unit. Earlier cost deferred to true-up. Now State regulator KSERC allows next month recovery via FPPAS. Summer bill will spike because State Government PSU bought costly power — not because you used more.

05. TRAP 3 — Peak Extended — State Government Decision

Mathrubhumi 19 Oct: Peak extended 6pm-10pm to 6pm-11:30pm — State regulator decision. Domestic families cooking 7-11pm now all peak.

06. TRAP 4 — 4% Auto Pass-Through — State Uses Central Rule

Central Rules 2022 allow 4% auto recovery. State Government via KSERC decided to implement it fully for KSEB. State Government could have capped lower, could have required prior approval, but did not. State Government chose consumer burden.

07. TRAP 5 — ToD Meters — State Government Mandate

State regulator mandates ToD meters for more categories. Cost, timeline undisclosed — State Government to decide who pays.

10. What Is Still Protected

Protection 1 — FPPAS Exemption: Domestic ≤1000W and ≤40 units exempt — Hindu 19 Oct
Protection 2 — No hike 2026-27: No increase approved for 2026-27 — real hike 1 Apr 2027 — 5 months to prepare against State Government hike
Protection 3 — Storage Incentive: Household storage incentive — green tariff

12. RTI Toolkit — 6 Questions to Break State Government Closed Loop

Question 1 — Rs 5000cr True-Up — State Govt Accountability

Certified copy of regulatory asset approved after true-up of 2023-24 State Government accounts, breakup principal vs interest, category-wise surcharge, and note file where State Government approved KSEB proposal to recover from consumers instead of business reforms.

Question 2 — FPPAS Sheet — State Govt Short-Term Purchase

Month-wise power purchase cost of State PSU KSEB — long-term, medium-term, short-term exchange rate separately — to expose Rs 10-12 short-term loading into FPPAS approved by State regulator.

Question 3 — KSEBL Land Rent — State Govt Private Drama

As per RTI 286 — certified copy of GO exempting KSEBL from commercial lease/RoW fees for state-owned land, total land occupied by KSEBL in each district, rent collected 2024-26, pending arrears — to prove private on paper, State-controlled in reality.

Question 4 — Peak Extension Data — State Govt Justification

Kerala grid load curve 2024-26 hourly 6pm-11:30pm — justification for extending peak from 4 to 5.5 hours by State regulator.

Question 5 — ToD Meter Cost — Who Pays?

ToD meter spec, cost, who pays — consumer or State PSU KSEB — timeline for LT domestic — cost-benefit for average 200 unit consumer.

Question 6 — State Government Appointments — Closed Loop

List of KSERC Chairman and Members appointed by State Government since 2021, their previous posting (ex-KSEB/ex-Power Dept), and copy of appointment orders — to prove State Government appoints regulator who regulates State Government PSU.

13. Checklist Before 1st April 2027 — Fight State Government Hike

Kerala does not have Central Government tariff problem. Kerala has State Government accountability problem.
KSEB does not have revenue gap — it has State Government business model failure — Rs 5,000 crore gap created under State Government, now put on your bill.
We do not have independent regulation — we have State Government appointed regulator allowing automatic 4% pass-through.
KSEBL is called private when RTI asks for land rent truth, but State-controlled when salary needs money and tariff hike needed.

State Government says KSEBL is private but controlled by Government, all money spent for staff is by Government, and they are not providing truth via RTI — RTI 286/IKM/2026 — 84 days deemed refusal — is live proof. State Government does not know how to do business and make money for State — so it recovers via your electricity bill. End of day, treasury fills, not because KSEB made profit by doing business, but because State Government taxes honest consumer who pays. Cross-check State Government order, not just KSEB bill. That is how citizens bell the cat — against State Government, not Central.
